When determining what is an appropriate child custody or visitation arrangement, the Courts are required to consider the “best interest of the child” involved in the custody dispute. In the ideal situation, co-parenting can be done without the need for Court involvement. However, if you feel that the custody and visitation arrangement is not in the best interest of the child or is otherwise unsatisfactory, either parent can Petition the Court for an Order of Custody and Visitation to be set in place. Likewise, if there is already and Order determining Custody and Visitation, a Petition to Modify that Order may be filed to ask that the Court change the Custody and Visitation Order. It is always a good idea to have competent legal counsel to assist you in this process and to advocate for your rights as a parent.
